General Terms and Conditions (GTC)

1. Scope

These general terms and conditions (GTC) apply to all orders placed by consumers (Section 1 of the Consumer Protection Act) via our online shop at www.idilay.com. A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity.

2. Contracting parties and conclusion of contract

The purchase contract is concluded with Idilay / owner Servet Kara, Siglgasse 18 / 2700 Wiener Neustadt.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. You will receive a confirmation by email immediately after submitting the order.

3. Prices and payment terms

All prices in our online shop are final prices and include statutory sales tax.

Payment is made using the payment methods offered in the ordering process (e.g. credit card, PayPal, instant bank transfer). The purchase price is due immediately upon conclusion of the contract.

4. Shipping and delivery conditions

We only deliver within the countries specified in the online shop. Shipping costs are clearly stated during the ordering process and are to be borne by the buyer unless free shipping is offered.

Delivery times may vary depending on the destination and are visible during the ordering process. The order will be processed within 1-2 working days after receipt of payment.

5. Retention of title

The goods remain our property until the purchase price has been paid in full.

6. Right of withdrawal

Consumers have a legal right of withdrawal. The conditions, deadlines and consequences of the right of withdrawal can be found in our cancellation policy .

7. Warranty

The statutory warranty rights apply. If the goods delivered are defective, you have statutory claims for subsequent performance (remedy of the defect or replacement delivery) and - if the statutory requirements are met - further claims for reduction or withdrawal.

8. Liability

We are liable without limitation for damages resulting from injury to life, body or health that are based on an intentional or negligent breach of duty on our part.

Otherwise, we are only liable for intent and gross negligence. We are only liable for minor negligence if essential contractual obligations (cardinal obligations) are violated. In these cases, liability is limited to the damage that is typical for the contract and foreseeable.

9. Dispute settlement

The EU Commission provides a platform for online dispute resolution (ODR), which you can access at [ https ://ec .europa .eu /consumers /odr/ ]. However, we are not obliged and generally not willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Final provisions

Should individual provisions of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provisions.

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
